Understanding Florida purchase agreements.

Florida residential purchases typically use standard contract forms published by Florida REALTORS® and The Florida Bar, customized with addenda for financing, inspections, HOA/condo, and AS-IS terms. Key contract elements

The agreement covers purchase price, earnest money deposit amount and due date, inspection period length, financing contingency deadline, appraisal contingency if included, target closing date, personal property inclusions, and who pays title insurance and documentary stamps. Florida documentary stamp tax on the deed is typically a seller cost; buyers pay stamps on the note if financing.

Contingencies

Standard contingencies protect buyers on inspection, financing, and appraisal. The inspection period lets you cancel or negotiate based on property condition. Financing contingency preserves your deposit if the loan cannot be obtained on agreed terms. Waiving contingencies can strengthen an offer but increases risk — we help you balance competitiveness with protection.

AS-IS vs repair requests

Many Florida listings sell AS-IS with right to inspect. That does not mean you skip inspection — it means the seller may refuse repairs and you decide whether to proceed, renegotiate, or cancel within the inspection period. Know your exit rights before the deadline passes.

Condo and HOA addenda

Condo purchases attach association approval and document review contingencies. Buyers receive estoppel letters confirming fees paid, special assessments, and violations. Missing an HOA deadline can forfeit your deposit — calendar every date the day you go under contract.
